1. Acceptance of terms

These Terms & Conditions ("Terms") govern your access to and use of the Online Hustle website, platform, and services (collectively, the "Platform"), operated in Kenya. By creating an account, browsing gigs, or otherwise using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use the Platform.

2. Eligibility

To use Online Hustle, you must:

• Be at least 18 years old, or have the consent of a parent or legal guardian if you are between 16 and 18.
• Provide accurate and truthful information when creating your account.
• Have a valid Kenyan M-Pesa-registered phone number for receiving payments.
• Not be barred from using the Platform under applicable Kenyan law.

3. Your account

You are responsible for maintaining the confidentiality of your account login details and for all activity that occurs under your account. Each user is permitted only one account, tied to a single phone number, to ensure fair access to gigs for everyone.

If you suspect unauthorized use of your account, notify us immediately via our Contact page.

4. Gigs and work

Online Hustle acts as a platform connecting workers to available online gigs, including but not limited to chat support, data entry, online surveys, translation, virtual assistance, and content writing.

• Gigs are offered on a flexible, non-employment basis — completing a gig does not create an employer-employee relationship between you and Online Hustle.
• You are responsible for completing accepted gigs accurately, honestly, and within any stated deadlines.
• Online Hustle reserves the right to review, approve, or reject submitted work based on quality and compliance with gig instructions.
• Falsifying, plagiarizing, or submitting fraudulent work may result in rejection of payment and suspension of your account.

5. Payments & M-Pesa

Earnings from completed and approved gigs are paid out via M-Pesa to the phone number registered on your account.

• Payouts are typically processed within 24 hours of gig approval, though timing may vary.
• A minimum withdrawal threshold may apply, as shown on your earnings dashboard.
• You are responsible for ensuring your registered M-Pesa number is accurate and active.
• Online Hustle is not liable for delays or losses caused by incorrect payment details provided by you.

6. User conduct

When using the Platform, you agree not to:

• Provide false, misleading, or fraudulent information.
• Create multiple accounts or impersonate another person.
• Harass, threaten, or abuse other users, clients, or Online Hustle staff.
• Attempt to bypass, hack, or interfere with the security or normal operation of the Platform.
• Use the Platform for any unlawful purpose or in violation of Kenyan law.

Violation of these conduct rules may result in immediate suspension or termination of your account.

7. Intellectual property

All content on the Online Hustle Platform — including the logo, design, text, graphics, and software — is the property of Online Hustle or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, or distribute our content without prior written permission.

Work you submit as part of a gig may be subject to separate ownership terms specified within that gig's instructions.

8. Suspension & termination

We reserve the right to suspend or terminate your account at our discretion, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or otherwise misused the Platform.

You may also close your account at any time by contacting our support team. Outstanding, approved earnings will still be paid out following standard processing timelines.

9. Disclaimers

The Platform and all gigs are provided on an "as is" and "as available" basis. While we strive to verify gigs and maintain a reliable service, we do not guarantee:

• A specific level or consistency of earnings.
• Uninterrupted or error-free access to the Platform at all times.
• The availability of any particular gig at any given time.

10. Limitation of liability

To the fullest extent permitted by Kenyan law, Online Hustle shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the Platform, including loss of income, data, or opportunity.

11. Indemnification

You agree to indemnify and hold harmless Online Hustle, its founders, employees, and partners from any claims, damages, or expenses arising from your violation of these Terms or misuse of the Platform.

12. Changes to these terms

We may update these Terms from time to time to reflect changes in our services or applicable law. Continued use of the Platform after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically.

13. Governing law

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya.
